1. Introduction

Welcome to Brōta Riot. By accessing or using brota-home.com (the "Site") or purchasing our products, you agree to be bound by these Terms of Service ("Terms"). If you don't agree, please don't use the Site.

2. Eligibility

To purchase from Brōta Riot you must:

• Be at least 18 years old (or the age of majority in your jurisdiction)
• Provide accurate, complete information
• Have legal capacity to enter contracts
• Not be prohibited from purchasing under applicable law

We may refuse service to anyone at our discretion, particularly for suspected fraud or violation of these Terms.

3. Products and Pricing

Product descriptions

We aim for accuracy in product descriptions, images, dimensions, and materials. Despite our efforts:

• Color variations may exist due to monitor calibration and lighting conditions
• Hand-crafted items have natural variations ("imperfections are the point")
• Dimensions are approximate (±5%)
• We reserve the right to correct errors in pricing or descriptions discovered after order placement

Pricing

• All prices in USD unless otherwise specified
• Currency converter is approximate; final price at checkout in your selected currency
• Taxes (VAT, sales tax, customs) calculated at checkout where applicable
• We reserve the right to modify pricing without prior notice (but never after order is placed)

Availability

Listed items are subject to availability. If an item becomes unavailable after purchase, we offer:

• Full refund, or
• Substitute item of equal value with your consent

4. Orders and Payment

Order acceptance

Submitting an order is an OFFER. We accept by:

• Sending order confirmation email
• Processing payment

We reserve the right to refuse or cancel any order at our discretion, including for:

• Suspected fraud
• Inventory errors
• Pricing errors
• Violation of these Terms

If we cancel, full refund within 7 business days.

Payment methods

We accept payment via Shopify Payments, PayPal, Apple Pay, Google Pay, and other methods displayed at checkout. Payment must be received in full before we ship.

Order changes / cancellation

You can change or cancel within 4 hours of placing your order by emailing support@brota-home.com. After 4 hours, your order may have been processed and changes may not be possible.

• Shipping costs and delivery times shown at checkout
• Free shipping on orders over $75 USD / €75 / MX$1,500
• We ship from US warehouses (3-7 days), EU warehouses (5-10 days), and Asian specialty workshops (10-21 days)
• Customs/duties may apply to international orders (buyer's responsibility outside US/EU/UK/MX)

Brief summary:

• 14 days from receipt for full refund
• Items must be in original condition with packaging
• EU customers: we pay return shipping
• US under $300: we pay return shipping
• Mexico and other regions: customer pays unless our error

7. Intellectual Property

Our IP

All content on the Site (text, images, logos, designs, code) is owned by Brōta Riot or licensed by us. You may NOT:

• Reproduce, distribute, or sell our content without written permission
• Use our trademarks ("Brōta", "Brōta Riot") without permission
• Reverse engineer or copy our website code
• Use our product images for commercial purposes (you may use product images you took yourself)

You MAY:

• Share our content on social media with credit (@brotariot)
• Use our images for personal blog posts with credit + link to product
• Download images for your own personal reference

Your IP

By submitting content to us (reviews, photos, comments), you grant us a worldwide, royalty-free license to use, modify, and display that content for marketing purposes. You retain ownership.

8. User-Generated Content

If you tag us (#brotariot) or submit reviews:

• You confirm the content is yours or you have rights to share it
• You grant us license to use it (see Section 7)
• We may modify or refuse content that violates these Terms (offensive, illegal, defamatory)
• We may remove content at our discretion

9. Prohibited Uses

You agree NOT to:

• Use the Site for unlawful purposes
• Attempt to gain unauthorized access to our systems
• Use bots, scrapers, or automated tools without written permission
• Impersonate Brōta Riot or any third party
• Engage in fraudulent transactions
• Resell our products in bulk without prior agreement
• Use the Site to send spam or harassing messages
• Violate the rights of others (IP, privacy, etc.)

We may suspend or terminate your access for violations.

10. Disclaimers

"AS IS" basis

The Site and products are provided "AS IS" without warranties of any kind, except as required by law. We don't warrant:

• The Site will be uninterrupted or error-free
• Products will meet your specific needs
• Color renderings will match exactly across devices

Limited warranty (decor + lighting)

Most products carry a 30-day defect warranty from delivery as Brōta Riot voluntary coverage. Defects = manufacturing flaws, broken on arrival, or non-functional electronics. NOT covered: normal wear, misuse, accidental damage.

Statutory warranties additionally apply:

• Mexico (LFPC Art. 79): 60-day mandatory product warranty
• EU (Directive 2019/771/EU): 2-year statutory legal guarantee
• California: standard implied warranties under Song-Beverly Consumer Warranty Act

These statutory warranties run concurrently with our voluntary 30-day · whichever is longer/more favorable to consumer applies.

Statutory rights preserved

None of these terms limit your statutory rights as a consumer under your local law (EU Consumer Rights Directive, CCPA, LFPC, etc.).

11. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability for any claim is limited to the amount you paid for the relevant order
• We're NOT liable for indirect, incidental, consequential, or punitive damages
• We're NOT liable for delays caused by third parties (carriers, customs, weather)

Statutory rights in your jurisdiction may not be limited; nothing here removes them.

12. Indemnification

You agree to indemnify Brōta Riot, its officers, employees, and partners from any claims arising from:

• Your violation of these Terms
• Your violation of third-party rights
• Your misuse of products

13. Modifications to Terms

We may modify these Terms at any time. Changes effective:

• Immediately upon posting (for minor clarifications)
• 30 days after posting (for material changes)

We'll notify users via email or banner for material changes. Continued use after changes = acceptance.

14. Governing Law and Disputes

Governing law

These Terms are governed by the laws of Mexico. Brōta Riot operates under Mexican RFC (founder = persona física con actividad empresarial registered in México central). Mexican law applies to all transactions globally.

Dispute resolution

We prefer to resolve disputes informally. Email legal@brota-home.com first. If informal resolution fails:

• Mexico: jurisdiction of PROFECO (Procuraduría Federal del Consumidor) and the competent courts of México central
• EU consumers: you may use the EU Online Dispute Resolution platform for cross-border disputes
• USA consumers: PROFECO jurisdiction applies as primary · USA federal courts for disputes over $10K USD under ICC arbitration
• International (>$10K USD): arbitration under ICC Rules in Ciudad de México, single arbitrator

15. Severability

If any provision is found unenforceable, the rest remains in effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Brōta Riot.
